About this Unit
The focus of this unit is the law relating to medical malpractice by medical providers. It examines the whole range of situations where a medical professional may be legally responsible. This includes damages claims for breach of contract, negligence, assault, battery, wrongful imprisonment, liability for breach of confidence, and potential liability under the Trade Practices Act 1974 (Cth) and Fair Trading Legislation. The reform of medical malpractice liability and mechanisms available for complaints and insurance arrangements through professional bodies and indemnity insurance are examined.
