About this Unit
This unit examines the history and sources of Islamic law and jurisprudence including the selected areas of personal law, family law, inheritance law, contract and economic law, criminal law and relations with non-Muslims. Sources of international law are examined as are various principles of international law including the prohibition of the use of force, the principle of non-intervention, and the principle of peaceful settlement of disputes. The law and policy of key States will be analysed as well as that of some international organisations (including the Organisation of Islamic Cooperation and the Arab League). A number of important judgments of the International Court of Justice and international arbitrations involving Muslim States will be analysed. Core international human rights treaties are examined with a particular focus on Islamic Human Rights instruments (including the Universal Islamic Declaration of Human Rights, the Cairo Declaration on Human Rights in Islam and the Arab Charter on Human Rights). Students will also engage with a number of contentious and contemporary issues including the relationship between law and religion, concepts of universality and cultural relativism within the context of human rights, free speech and blasphemy, equality of the sexes, terrorism and security.
